Terms of Service

Last updated: March 22, 2026

These Terms of Service (“Terms”) govern your access to and use of Everest Market’s website, applications, and related services (collectively, the “Services”). By creating an account, accessing, or using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization. The legal name of the operating entity, jurisdiction, and registered address must be inserted by your legal counsel.

1. Eligibility and account registration

You must be of legal age in your jurisdiction and capable of entering a binding contract. You agree to provide accurate registration information and to keep it updated. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of unauthorized use. We may offer sign-in with email and password and, where enabled, with Google or other providers subject to their terms as well.

2. Description of the Services

Everest Market provides an online platform that may include digital asset trading interfaces, wallet and ledger features, funding flows, optional modules such as campaigns, AI investing, loans, notifications, and messaging, as made available in your account. Features may vary by region, account type (e.g. demo vs live), and administrator configuration. We may modify, suspend, or discontinue features with reasonable notice where practicable.

3. Risk disclosure

Digital assets are highly volatile. You may lose some or all of the value you allocate. Past performance does not guarantee future results. Nothing on the platform constitutes investment, tax, or legal advice. You are solely responsible for evaluating risks and for compliance with laws applicable to you. If you do not accept these risks, do not use the Services.

4. Wallet, funding, and transactions

Deposits, withdrawals, and internal transfers are subject to network fees, processing times, verification, and administrative review where applicable. You represent that funds and assets you use are lawfully obtained. We may delay or refuse transactions to comply with law or mitigate fraud. Recordkeeping is performed as described in our Privacy Policy.

5. Acceptable use

You agree not to misuse the Services, including: violating law; infringing others’ rights; attempting unauthorized access; interfering with infrastructure; laundering money or financing crime; manipulating markets; using the Services from sanctioned jurisdictions if prohibited; or harassing users or staff. We may investigate and suspend or terminate accounts for violations.

6. Intellectual property

The Services, branding, software, and content (excluding your content and third-party materials) are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal or internal business use as intended. You may not copy, reverse engineer, or scrape the Services except as allowed by law.

7. Third-party services

Core application data is processed and stored using PostgreSQL on infrastructure we operate (for example on servers we control or lease). The Services may also integrate or link to third parties (e.g. Google sign-in, email providers, media hosting, blockchain networks). Their terms and privacy policies apply to your use of those services. We are not responsible for third-party content or failures outside our reasonable control.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; IN THOSE CASES, DISCLAIMERS APPLY TO THE MAXIMUM EXTENT PERMITTED.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN FEES FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED US DOLLARS (USD 100), UNLESS MANDATORY LAW REQUIRES OTHERWISE.

10. Indemnity

You will defend, indemnify, and hold harmless Everest Market and its affiliates from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms or law, except to the extent caused by our gross negligence or willful misconduct.

11. Suspension and termination

We may suspend or terminate your access for breach of these Terms, risk, legal requirement, or operational reasons. You may close your account subject to settlement of obligations. Provisions that by nature should survive (e.g. liability limits, indemnity) will survive termination.

12. Governing law and disputes

These Terms are governed by the laws of the jurisdiction selected by the operating entity, without regard to conflict-of-law rules. Courts or arbitration in that jurisdiction (as specified by your counsel) have exclusive venue unless mandatory consumer protections in your country require otherwise. Insert specific governing law, venue, and dispute resolution after legal review.

13. Changes to the Terms

We may update these Terms. We will post the new version and update the “Last updated” date. Material changes may require additional notice or consent where required by law. Continued use after the effective date may constitute acceptance.

14. Contact

For questions about these Terms, contact us through the support channel or email published in the application. Replace with your official legal contact after review.
